Important change to the Temporary Skilled Migration Income Threshold (TSMIT)

By Aylward Game - May 30, 2023 Immigration Law

This article highlights an important change to the Temporary Skilled Migration Income Threshold and what it means for those who are after applying for this visa and the employers who are to nominate a skilled worker to come to Australia.

What is the gist of the change?

The TSMIT deals with setting the minimum amount which must be paid to the would-be worker under the employer sponsored skilled scheme. This amount is now set as $70,000 per annum.

When will the change be effective and what is the required working hours?

As of 1 July 2023, the TSMIT will rise to the amount indicated above and that is based on a standard 38 hours work per week.

Will the change have any impact on current employer sponsored skilled workers?

No. This will only apply to nominations lodged with the Department of Home Affairs on or after 1 July 2023.

I am an employer and need to lodge my application before 1 July 2023, what threshold income will I be subject to?

If you lodge your application prior to 1 July 2023 and providing all other things being equal, the income threshold to comply with is $53,900.

Is labour market testing still required?

Yes, for most nominations the labour market testing is still required and the employers must show that the position has been advertised for at least four weeks within the four months period immediately prior to lodging the nomination application.

Take-home message

Time is gold. Therefore, if you require to nominate a skilled worker under the scheme, you may want to lodge your application as soon as possible.
